These terms and conditions of service (Terms) outline the rules and regulations for the use of Alquran Test Encyclopaedia Website.

Alquran Test Encyclopaedia website is owned and operated by the International Institute for Quran Education Pty Ltd (IIQE), a not-for-profit and charity organisation, registered and based in Sydney, Australia. The website renders a unique, universal online service that specifically pertains to the study of the Noble Qur’an, in terms of both memorisation and revision.

The following terminology applies to these Terms and Conditions, Privacy Policy, Refund Policy and Disclaimer Notice and any or all Agreements: “The Organisation”, “Ourselves”, “We”, “Our” and “Us”, refers to the IIQE. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Organisation’s terms and conditions of use. “Alqurantest”, “Website” and the “Site” refer to Alquran Test Encyclopaedia Website. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of obtaining our service through accessing the website in accordance with and subject to, prevailing law of Australia. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore are referring to same.

By visiting, registering, accessing or using any part of, or subscribing with, Alqurantest you engage in our “Service”, and we assume you accept and agree to be bound by the following terms and conditions of use in full. You also agree to refrain from any behaviour that may disrupt our Service or cause distress to our user group. Our service is to be accessed and/ or used only with proper respect for the Islamic religion, culture and its devotees. These Terms apply to all users of the Website, including, without limitation, users who are browsing, subscribing, and/or contributing content.

All users are urged to read these Terms carefully before accessing or using Alqurantest. Do not continue to use this website if you do not accept all the terms and conditions stated on this page.

You can review the most current version of the Terms at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates and/ or changes to the website. It is your responsibility to check this page periodically for changes. Your continued use of or access to Alqurantest following the posting of any changes constitutes acceptance of those changes.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 1 - OUR SERVICE

Al-Qur’an tests are available exclusively online through the website as our service. This service may be subject to refund only according to our Refund Policy.

We have made every effort to display the texts, colours and images of Al-Qur’an tests as accurately as possible. We cannot guarantee that your computer monitor's display of any colour will be accurate, but we will do our best to maintain a very satisfactory level of service that will meet users' expectations.

We do not promise that our Site will be available 24 hours a day, 7 days a week. Sometimes, our Site may be unavailable due to scheduled or unscheduled repairs or other circumstances that may be beyond our control. You agree to waive any losses that you incur due to any such service outage.

We reserve the right to limit, modify or discontinue our service (or any part or content thereof) at any time to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

SECTION 2 - MODIFICATIONS TO THE SERVICE AND SUBSCRIPTION FEES

As a not-for-profit and charity organisation, IIQE does not impose any registration fees. However, subscription fees are charged, and they are as small as one Australian dollar per day per registered subscriber for a minimum of five days per order. These fees are subject to change, and additional fees may be added at our sole discretion, particularly when we add new services.

IIQE subscription fees are not time-based; they are usage-based. This means that the fees are calculated upon the actual logging in and usage of the Website. If a subscriber, with five dollars on their account, logs into the Site, one dollar would be used for that day, and the other four dollars would remain on the account even if the subscriber does not log in for days or even months. In contrast, a time-based subscription would use up the five dollars at the end of the first five days of purchasing the service, regardless of whether the subscriber has used the service or not.

Fees are charged and collected instantly upon registering or renewing subscription. You may cancel your paid subscription at any time; refunding may be made according to our Refund Policy. Upon termination of your paid subscription, you will no longer be able to access or take tests.

We shall not be liable to you or to any third party for modification, fee change, suspension or discontinuance of the service.

SECTION 3 – ONLINE SUBSCRIPTION

Your subscription to Alqurantest requires you to submit your true name, your valid email address, as well as your country of residence. You will be solely responsible for maintaining the security of your user ID and password.

Should you decide to purchase a paid subscription, you must be legally eligible to enter into a binding contract, be of at least 18 years of age, submit only true, complete and accurate personally identifiable information to us, keep this information updated and maintain the accuracy of this information.

Your use of our Site must not violate the law in any jurisdiction.

We may, at our sole discretion, limit some areas of the Site, as well as certain tools, services and functions, to members, and designate them as “off limits” to members of the general public.

Your subscription is your express agreement that you agree to receive Site-related emails from us from time to time that contain information and offers from third parties. You will be provided an opt-out function for such communications. Note that we must always be able to email you regarding standard business issues regarding the administration of our Site and business, and you may not opt-out of such non-marketing business email communications.

Subscriptions are not transferrable and may not be sold, exchanged or given away.

SECTION 4 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are responsible for any inaccuracy, incompleteness or outdatedness of information made available on this Site. The Qur’anic material on this Site is provided for the benefit of all people around the world and can be relied upon as an authentic and legitimate source for Qur’anic questions and tests.

Nevertheless, we will not be responsible for inaccuracy, incompleteness or outdatedness of information resulting from having the Site being tampered with by hackers, web crawlers, robots and viruses, notwithstanding the high security measures implemented on the Site.

SECTION 5 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

If you use this Site, you are responsible for maintaining the confidentiality of your account and password, and for restricting access to your computer. You also agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. Alqurantest is not responsible for third-party access to your account resulting from theft or misappropriation of your account. Alqurantest reserves the right to reject, limit or cancel service or any subscription request, terminate accounts, and remove or edit content at its sole discretion.

Your submission of personal information through the Website is governed by our Privacy Policy. Upon registration, we collect only three items from our users: names, email addresses and countries of residence, which are the basic details necessary for communicating and creating an account on our Website. Upon subscription, credit card details are added to enable to payment of subscription fees.

Once you acquire our online service, you agree to provide current, complete and accurate subscription and account information. You also agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 6 - RULES OF CONDUCT

“Intellectual Property” means any material that is copyright protected under Australian law or the law of any nation, as well as any trademark, trade dress, product, service, text, software, video, graphic or sound file.

You agree that you do not and you will not assist or permit any third party to: (a) copy, store, reproduce, transmit, modify, alter, reverse-engineer, emulate, de-compile, or disassemble our intellectual property in any way, or create derivative works; (b) use our intellectual property or any part of it to create any tool or software product that can be used to create software applications of any nature whatsoever; (c) rent, lease, loan, make available to the public, sell or distribute our intellectual property in whole or in part; (d) tamper with our Site, functions, tools or services or circumvent any technology that we employ to protect any content accessible through the subscription service; (e) circumvent any territorial restrictions applied to our products and services, or use our site or tools, services or functions in a way that violates these terms; (f) independently provide any of our intellectual property to any third person or entity or use it in any manner not expressly authorised by us; and (g) violate the law of any jurisdiction while using our site, tools, services, functions or products.

You agree not to upload, post, email or otherwise send, transmit or introduce any material that contains software viruses, or any other computer code, files or programs designed to interrupt, harm, damage, destroy or limit the functionality of any computer software, hardware or equipment linked directly or indirectly with our Site or its functions.

You agree not to interfere with the servers or networks underlying or connected to our site or our services or to violate any of the procedures, policies or regulations of networks connected to our site. You may not access our Site or any product, service, tool, or function in an unauthorised manner.

You agree not to impersonate any other person while using our site, conduct yourself in an offensive manner while using our site or use our site for any illegal, immoral or harmful purpose. Any user-generated content that you provide us is presented to us by you in conjunction with a mandatory, transferrable, royalty free, perpetual license. This includes any text, graphics, sound files, video files and any other content that is or will be uploaded to us by you now or in the future. You are solely responsible for any legal issues, liability and damages associated with any content that you upload to us, including any violations of intellectual property laws. We are free to edit, censor or remove any user-generated content and you agree that we have no duty to do so.

SECTION 7 - USER COMMENTS, FEEDBACK AND TESTIMONIALS

Users, without a request from us, are always welcome to submit their comments, feedback and testimonials to the website administration. Feedback that includes, but is not restricted to, creative ideas, suggestions, proposals and plans may be submitted by email or by postal mail.

For all submissions, users agree that we may, at any time and without restriction: edit, copy, publish, censor, distribute, translate and otherwise use in any medium any comments that users submit to us. We are, and shall be, under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We reserve the right to screen, monitor, edit, remove, publish and review comments content prior to their appearance on the website. Content that we determine, in our sole discretion, to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violating of our ethics, intellectual property or these Terms, will instantly be deleted.

Comments do not reflect the views or opinions of IIQE, its agents or affiliates. They reflect only the views and opinions of the individuals they belong to. To the extent permitted by applicable laws, IIQE shall not be responsible or liable for the comments or for any loss, liability, damage or expense incurred as a result of any use of and/or posting of and/or appearance of the comments on this website.

You warrant that: (1) You are entitled to post comments on our website and have all necessary licenses and consents to do so; (2) The comments do not violate or infringe any intellectual property right, including - without limitation -: copyright, patent or trademark, privacy or personality, or other proprietary rights of any third party; (3) The comments do not contain material that is defamatory, libellous, offensive, abusive, indecent, obscene, unlawful or invading of privacy, which will otherwise be instantly removed before publishing; (4) You will not use false email addresses, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments; (5) The comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity; and (6) You hereby grant to IIQE a non-exclusive royalty-free license to use, reproduce, edit and authorise others to use, reproduce and edit any of your comments in any and all forms, formats or media.

SECTION 8 - PROHIBITED USES

You are granted a non-exclusive, non-transferable revocable licence to access and use our site strictly in accordance with these terms of use. As a condition of your use of the site, you warrant to IIQE that you will not use the Alqurantest for any purpose that is unlawful or prohibited by these terms. You may not use the site in any manner which could damage, disable, overburden, or impair the site or interfere with the use of the site by any other party. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided through the site. You may not use the site to publish any content that we find, at our sole discretion, to be blasphemous or disrespectful to the Islamic religion, people or culture.

All content included as part of the service such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the site, is the property of IIQE and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by the copyright contained by other proprietary notices and legends for other restrictions in any such content and will not make any changes thereto.

You will not copy, modify, publish, republish, transmit, reverse engineer, reproduce, rent, sell, participate in the transfer or sale of, create derivative works of, or in any way exploit the content found on Alqurantest site, in whole or in part. Alqurantest content is not for resale. Your use of the site does not entitle you to have any ownership rights over its protected content, and in particular, you will not delete or alter any proprietary rights or attribution notices therein. You will use protected content solely for your personal use and will make no other use of content without the express written permission of the IIQE.

You agree that you do not have any ownership rights in any of the protected content. We do not grant you any licences, expressed or implied, for the intellectual property of IIQE or our licensors except as expressly authorised by these terms. Unauthorised commercial use of our site or its functions is strictly prohibited.

In addition to previous prohibitions, users are prohibited from using the site or its content: (a) to solicit others to perform or participate in any unlawful acts; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, religion, ethnicity, race, age, national origin, or disability; (e) to submit false or misleading information; (f) to collect or track the personal information of others; (g) to spam, phish, pharm, pretext, spider, crawl, or scrape; (h) for any obscene or immoral purpose; or (i) to interfere with or circumvent the security features of the service or the website, other websites, or the Internet. We reserve the right to terminate any user's access to the website for violating any of the prohibited uses.

SECTION 9 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that users' use of our Service will be uninterrupted, timely, secure or error-free.

Users agree that from time to time we may need to pause the service for pre-determined periods of time for maintaining and servicing the website databases and servers. Users will be notified in advance about the dates and times for which the service will be offline.

In no case shall IIQE, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including - without limitation -: lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from the user’s use of the Site, or for any other claim related in any way to their use of the service, including, but not limited to, any errors or omissions in any content, or loss or damage of any kind incurred as a result of the use of the Service or any content posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by the law of such states and jurisdictions.

SECTION 10 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless: IIQE, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or right of a third party. IIQE reserves the right, at its own cost, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with IIQE in asserting any available defences.

SECTION 11 – ARBITRATION

In the event the parties are not able to resolve a dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of, or concerns, these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regard to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including tort claims that are a result of these Terms and Conditions. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions. Arbitration shall be conducted in Sydney.

SECTION 12 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such a right or provision.

SECTION 13 - TERMINATION

You agree that no joint venture, partnership, employment, or agency relationship exists between you and IIQE as a result of this agreement or use of the site. IIQE's performance of this agreement is subject to existing laws and legal processes, and nothing contained in this agreement is in derogation of IIQE's right to comply with government, court and law enforcement requests or requirements relating to your use of the site or information provided to or gathered by IIQE with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and IIQE with respect to the site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, verbal or written, between the user and IIQE with respect to the site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based on or relating to this agreement to the same extent, and subject to the same conditions, as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents be written in English.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either IIQE or the user. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our services, or when you cease using our site.

If, in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly we may deny you access to our services (or any part thereof).

SECTION 14 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you with services shall be governed by and construed in accordance with the laws of Australia.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes on our website. We employ the use of cookies. By using Alqurantest you consent to the use of cookies in accordance with Alqurantest’s privacy policy. As an interactive website, Alqurantest uses cookies to enable us to retrieve user details for each visit. More details about cookies are in the Privacy Policy.

16-2 - Hyperlinking to our Content

In general, Alqurantest may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of Alqurantest. Therefore, Alqurantest is not responsible for the contents of any Linked Site, including, without limitation, any link contained in a Linked Site, or any changes or updates to a Linked Site. Alqurantest provides these links to the users only as a convenience, and the inclusion of any link does not imply endorsement by IIQE of the site or any association with its operators.

We may consider and approve, in our sole discretion, link requests from the following types of organisations: (a) Islamic religious educational institutions; (b) Any legitimate and registered charity and not-for-profit organisations and associations, worldwide; and (c) Selected secular educational institutions.

We will approve link requests from these organisations to our home page, to publications or to other site information if we determine that the link: (a) is not in any way misleading; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; (c) fits within the context of the linking party's site; (d) would not reflect unfavourably on us or on our accredited businesses and activities; (e) will be with an organisation that does not have an unsatisfactory record with us; (f) the hyperlink visibility outweighs its absence; and (g) is in the context of general resource information or is otherwise consistent with editorial content in a newsletter or in a similar product furthering the mission of the organisation.

You agree to immediately remove all links to Alqurantest upon such request. We also reserve the right to amend these Terms and Conditions and its linking policy at any time. By continuing to link to our website, you agree to be bound to and to abide by these linking terms and conditions.

If you find any link on our website or any linked website objectionable for any reason, you may contact us about this. We will consider requests to remove links but will have no obligation to do so or to respond directly to you.

Without prior approval and express written permission, you may not create frames around our webpages or use other techniques that alter in any way the visual presentation or appearance of Alqurantest.
